The petitioner is languishing in jail since 12.10.2014 in a case instituted under Sections 302, 201, 120(B) and 379/34 of the Indian Penal Code and 27 of the Arms Act. As per allegation, it is a case of murder of one Ranjeet Singh by the accused persons.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 12.10.2014. Chargesheet has been submitted in the case. There is no allegation of tampering of evidence against the petitioner. Petitioner has got no criminal antecedent. Petitioner has been named accused in this case merely
Patna High Court Cr.Misc. No.41655 of 2015 (3) dt.16-10-2015 on the basis of suspicion. Except the suspicion, there is no other material against the petitioner. The allegation of last seen is said to be against the other co-accused, namely, Ranjeet. On behalf of the State, it has been submitted that the petitioner is named in the FIR.
Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Sikrahana at Motihari in connection with Sessions Trial No.308 of 2015 arising out of Dhaka P.S.Case No.172 of 2014.
