JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 03-02-2020 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Jandaha P.S. Case No. 139 of 2019 for the offence under Sections 147, 148, 149, 341, 323, 307 and 504 of the Indian Penal Code and Section 27 of the Arms Act.

The allegation against the petitioner is that he used firearm which hit the waist of Fula Devi.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 09.09.2019. The alleged injury sustained by Fula Devi is on non-vital part of her body. Co-accused Vinod Sahani has been granted bail by a coordinate Bench of this Court vide order dated 02.12.2019 passed in Cr. Misc. No. 58908 of 2019. Considering the fact that similarly situated co-accused
