The petitioner apprehends his arrest in Parasbigha P.S. Case No. 208 of 2017, registered for the offences punishable under Section 302 and other allied sections of the Indian Penal Code and section 27 of the Arms Act As per the FIR, this petitioner along with other FIR named accused persons and 20-25 unknown persons entered into the house of informant and brutally assaulted the informant and family members with lathi due to which three persons succumbed to the injuries.

It is submitted that petitioner has been falsely implicated in this case simply because he is son of co-accused Lali Yadav with whom the informant has land dispute. There is general and omnibus allegation and he is simply member of

Counsel for State however, vehemently opposed the prayer for bail and submitted that petitioner is named in the FIR and due to assault three persons succumbed to the injuries. Considering the facts aforesaid and gravity of offence, I am not inclined to enlarge the petitioner above-named on anticipatory bail.
