The petitioner is in custody in a case registered under Sections 363, 366A/34 of the Indian Penal Code. The prosecution case in, brief, is that on 25.2.2014 at 11 A.M. the petitioner along with co-accused Raja Kumar has kidnapped Priyanka Kumari, aged about 17 years, the daughter of the informant by enticing her in pretext to marry. On behalf of the petitioner it has been submitted that the petitioner has got no criminal antecedent. He is in custody since 18.05.2015. Charge sheet has been submitted in this case. There is no allegation of tampering with the evidence against the petitioner. The main allegation is against Raja Kumar. The victim girl has already been married to one Rana Kumar. The petitioner

Patna High Court Cr.Misc. No.38008 of 2015 (4) dt.16-10-2015 2/2 has been falsely implicated in the present case. Document of marriage of co-accused Rana Kumar with the victim has been produced in course of argument. Let it be kept on the record. On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the facts aforesaid, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Khagaria in Parbatta P.S.Case No.37 of 2014.
