The petitioner apprehends her arrest in Uchakagaon P.S. Case No. 33/2016, registered for the offences punishable under Section 307 and other sections of the Indian Penal Code. Section 302 of the Indian Penal Code was added after death of Sudish Kumar son of the informant Bhiku Ram.
The informant asked who dig ditch at his door on such, the accused persons armed with different weapons came and assaulted the informant, his wife, son and the daughter-in-law. It is submitted that the petitioner Jaymati Devi alleged to have assaulted Punam Devi daughter-in-law of the informant, but Punam Devi did not get any apparent external injury. Bishuni Ram is alleged to have assaulted Sudish Kumar with lathi on his head
Patna High Court Cr.Misc. No.23881 of 2016 (3) dt.04-08-2016 2/2 and Sudish Kumar died on account of head injury. Considering the facts aforesaid and the fact that petitioner is alleged to have assaulted Punam Devi daughter-inlaw of the informant and she is not the assailant of the deceased, the petitioner above-named being the lady, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gopalganj in connection with Uchakagaon P.S. Case No. 33/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Jha, J.) Vinita/- U T
