In this case, the petitioner is seeking anticipatory bail in connection with Sangrampur P.S. Case No.94 of 2014, registered for the offence punishable under Sections 341, 323, 376, 511 and 34 of the Indian Penal Code.
Allegation has been made that the petitioner has tried to outrage the modesty of his Bhabi and when an alarm was raised then mother-in-law and father-in-law of the victim supported the act of the petitioner.
Learned counsel for the petitioner has drawn the attention towards the order passed by the Sessions Judge where the husband of the victim has specifically stated that no such
Patna High Court Cr.Misc. No.8713 of 2019(2) dt.14-02-2019 2/2 incident has taken place with his wife.
Looking to the entire facts and circumstances of the case, let the petitioner, above-named, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-II, Munger, in connection with Sangrampur P.S. Case No.94 of 2014, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
