Petitioner apprehend his arrest in a case registered for the offence punishable under sections 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. The petitioner is neither the owner nor the driver of the truck. Nothing has been recovered from his conscious possession. Petitioner claims clean antecedent.
