The petitioner seeks bail in connection with S.T. Case No. 285 of 2022 arising out of Mufassil P.S. Case No. 147/2022 registered for the offence under Sections 302/201/120B read with Section 34 of the Indian Penal Code.

As per prosecution story, on 01.05.2022 at about 10.15PM, husband of the informant alongwith his associate Vikash Kumar had gone out of his house on a bike. The husband of informant did not return home in the night. The informant asked Vikash Kumar, he told that he left her husband near SSY Bricks Kiln. On 04.05.2022, the informant found the dead

She suspected that Vikash Kumar and Sunil Kumar murdered her husband due to demand of Rs. 1,30,000/- which was arrear due on Sunil Kumar. Learned counsel for the petitioner submits that the petitioner is in custody since 05.05.2022.

Learned A.P.P. has vehemently opposed the prayer for bail.

Considering the fact that this is a case of last seen, considering the period of custody and the fact that Co-accused Sunil Kumar has been granted bail vide order dated 24.03.2023 in Cr. Misc. No. 58325 of 2022, this application for regular bail is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-2nd, Munger in connection with S.T. No. 285/2022 arising out of Mufassil P.S. Case No. 147 of 2022.
