This is the second attempt of the petitioner to obtain bail in connection with Sessions Trial No. 246/2019 arising out of Buxar (Town) P.S. Case No. 602/2019 registered for the offence under Sections 147, 148, 149, 302 of the Indian Penal code and Section 27 of the Arms Act.

Earlier his prayer for bail was rejected by this court vide order dated 11.06.2020 in Cr. Misc. No. 6222/2020. This Court has noticed that there is specific and direct allegation against the petitioner for opening fire on the deceased. The occurrence took place outside the Civil Court premises. The petitioner has also criminal antecedents.

Learned counsel for the petitioner as well as the informant submit that now the trial has begun in this case and

Considering the seriousness of the allegations, severity of the punishment attached to that and further that the trial has already begun, this Court is not inclined to direct release of the petitioner on bail.

Prayer for bail of the petitioner is, thus, refused. Let the trial be expedited on day to day basis.
