2. The petitioner is apprehending his arrest in connection with Jamui P.S. Case No. 621 of 2023, dated 18.10.2023, in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 332, 186, 353, 379, 411, 307 and 504 of the Indian Penal Code and under Section 21 of MMDR Act and under Section 56(2) of Bihar Mineral Act.
3. As per the prosecution case, while the informant along with other police personnel was conducting raids against illegal mining and liquor and moving towards Navinagar, they saw a red Mahindra tractor, loaded with sand, coming from Naginagar side and when the driver of the said vehicle saw the police, he tried to flee with the tractor but soon left the tractor

It is further alleged that all FIR named accused persons along with 10 to 15 unknown persons blocked the road and started pelting stones and bricks upon the police personnel and then they took away the said tractor, loaded with sand.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner was not present at the place of occurrence. The similarly situated co-accused persons namely, Kinjar Kumar Mandal & Ors. have been granted anticipatory bail by this Court vide order dated 23.08.2024 passed in Cr. Misc. No. 39760 of 2024. The petitioner has clean antecedent as stated in paragraph no. 3 of the bail petition.
5. Learned A.P.P. for the State has vehemently opposed the prayer for anticipatory bail of the petitioner.
6. Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, in the event of his arrest / surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail bond of Rs. 20,000/- (Rupees twenty thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jamui in connection with Jamui P.S. Case No. 621 of 2023, subject to conditions as laid down under
Patna High Court CR. MISC. No.7581 of 2025(2) dt.02-05-2025 3/3 section 438(2) of the Code of Criminal Procedure.
7. The application stands allowed.
