ANJANA MISHRA ORAL ORDER 31-08-2016 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.

The petitioner apprehends his arrest in connection with Katihar Town P.S. Case No. 473 of 2015 for the offences registered under Sections 363, 366, 376, 379/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that save and except the fact that the petitioner has been named in the first information report, there is no specific allegation against the petitioner. It is further submitted that even in the statement made by the victim girl under Section 164 Cr.P.C. no particular role has been attached to the present petitioner. The medical report also does not indicate the offence of rape. Moreover, the girl in question has been found to be a major.

No.24354 of 2016 (3) dt.31-08-2016 Having considered the facts and circumstances of the case and that there is no cogent material in the case dairy to implicate the petitioner in the present case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Katihar in connection with Katihar Town P.S.
