2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 25(1-b)a, 26 and 35 of the Arms Act.

3. The prosecution case, in nutshell, is that on 25.11.2025, informant, who happens to be A.S.I.-cum-S.I. of Police, received a photo on the official mobile phone of a man carrying illegal weapon. Upon receiving such photograph, informant, along with other police officials, went to the house of one Chandan Kumar in village Champanagar and on seeing the police party, this petitioner started running away, however, he was apprehended and on search of his room, one country made

Patna High Court CR. MISC. No.7030 of 2026(2) dt.19-02-2026 2/2 pistol, Ganja chillam and a mobile phone was recovered. Thereafter, this petitioner escaped from the police custody and fled away.

4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has committed no offence. Petitioner has falsely been implicated in this case with ulterior motive. Petitioner claims clean antecedents.

5. On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner and submitted that on raid, this petitioner was apprehended and from his possession, illegal country made pistol was recovered. However, taking advantage of the darkness, he fled away from the police custody.

6. Considering the facts and circumstances of the case, specific and direct nature of accusation and gravity of offence, the prayer for grant of anticipatory bail to the petitioner is rejected.
