The petitioners seek bail in a case registered for the offences punishable under sections 302/34 of the Indian Penal Code.

The informant named eight persons including the petitioners. The accused persons were removing diesel engine from the boring pump. Father of the informant objected. All the accused persons assaulted his father.

It is submitted that there is omnibus and general allegation. Co-accused Bashistha Yadav has already been enlarged on bail vide order passed in Criminal Misc. No. 11770 of 2014. The case of the petitioners stands on the same footing. The

Patna High Court Cr.Misc. No.39351 of 2015 (2) dt.27-08-2015 deceased got two injuries on his head when eight persons are alleged to have made indiscriminate assault.

Considering the facts aforesaid and the fact that the case of the petitioners stands on the same footing as that of Bashishtha Yadav, who has already been enlarged on bail, the petitioners, above named, are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Sasaram (Mufassil) P.S.
