Patna High Court Cr.Misc. No.6503 of 2019(2) dt.05-02-2019 2/3 arrest in connection with Runnisaidpur P.S. Case No. 12 of 2016, dated 08.01.2016, instituted for the offences under Section 392 of the Indian Penal Code.
Initially, a complaint was lodged by the complainant/informant alleging that while he was coming home, he was waylaid by the petitioners and was divested of Rs. 30,000/-. The aforesaid complaint was sent under Section 156(3) of the Cr.P.C. for institution of a regular case, whereupon the subject F.I.R. was registered. The learned counsel for the petitioners has submitted that the police, after investigation, submitted final report false, but on seeing the investigation papers, cognizance has been taken against the petitioners. For the nature of accusation raised in the F.I.R. and the police report which has been differed with as also taking into account the clean antecedents of the petitioners above-named, they, in the event of their arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of the present order, are directed to be released on bail on their furnishing
Patna High Court Cr.Misc. No.6503 of 2019(2) dt.05-02-2019 3/3 bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned 5th Addl. Chief Judicial Magistrate, Sitamarhi in connection with Runisaidpur P.S. Case No. 12 of 2016, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
