Petitioner apprehends his arrest in Nirmali P.S. Case No. 158 of 2015 under Sections 363, 365/34 and 120B of the Indian Penal Code registered on the basis of the statement of the victim, who was allegedly kidnapped but was released on intervention of the co-villagers.

It is stated that one accused person was arrested, who in his confessional statement named the petitioner. Apart from this, there is no direct evidence against him. In course of investigation, it has come that owing to the love affairs, the occurrence was committed, in which the informant after being kidnapped, was released on the same day. It is further stated that

Patna High Court Cr.Misc. No.24707 of 2016 (4) dt.24-08-2016 2/2 the petitioner is a book seller and lives close to the lodge where the informant resides. Still he was not named in the FIR. He has no criminal antecedent.

Looking to the facts and circumstances of the case, let the petitioner above named, in the event of arrest/surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Birpur in Nirmali P.S. Case No.158 of 2015 subject to the condition that one of the bailors shall be his own/close family member. The petitioner shall appear in person on each date fixed at the trial. In case of default in appearance on two consecutive dates, the trial court shall have liberty to cancel his bail bond. (Kishore Kumar Mandal, J.) ravi/- U T
