2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 420, 406, 467, 504, 506 and 34 of the Indian Penal Code.
3. The prosecution case, in brief, is that this petitioner, who is close friend of the informant, for doing business, borrowed Rs 23,00,000/- from him on different dates and when the informant demanded the money, he refused to pay. It is further alleged that a Panchayati was also held for that and petitioner gave assurance to return the aforesaid amount but never returned the same and thus petitioner cheated the informant.
4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has
Patna High Court CR. MISC. No.7425 of 2025(2) dt.18-03-2025 2/2 committed no offence. From bare perusal of the F.I.R. it is apparent that the dispute is civil in nature.

On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner and submitted that petitioner is named in the F.I.R. with specific accusation that he borrowed money from the informant but did not return the same. Petitioner has also got five criminal antecedents out of which three are of similar nature.
6. Considering the aforesaid facts and circumstances, nature of accusation and the fact that petitioner has got five criminal antecedents out of three are of similar nature, the prayer for grant of anticipatory bail to the petitioner is rejected. (Prabhat Kumar Singh, J) shashank/- U T
