Having regard to the fact that the petitioner faces allegation for offence under sections 304B/34 of the Indian Penal Code and is the husband, this Court is not inclined to grant bail to the petitioner for the present but then if the petitioner on receipt of the viscera report can still establish the theory of poisoning to be incorrect it will be open for him to renew his prayer for bail. With the aforementioned observation, this application is dismissed.
