JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 08-02-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Bochahan P.S. Case No. 310 of 2018 for the offenses under Sections 272, 273, 120B IPC and Sections 30(a)/38/41/44/45/47/48 of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent. The petitioner is in custody since 22.11.2018.

In the instant case, it is alleged that a container/ truck parked in a field loaded with liquor was seized. The Police have seen 8-10 persons standing besides the container and out of them two were arrested.

Patna High Court Cr.Misc. No.7544 of 2019(2) dt.08-02-2019 2/2 Learned counsel for the petitioner submits that the container was brought from Haryana through Lalit & Pradip. The petitioner has no concern either with the liquor or the container.

Considering the fact that the petitioner has no criminal antecedent and he is in custody since 22.11.2018, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Act, Muzaffarpur in connection with Bochahan P.S. Case No. 310 of 2018.
