The petitioner seeks bail in Bikram P.S. Case No. 207/2009, registered for the offences punishable under Sections 302, 324, 323, 307/34 of the Indian Penal Code.

The petitioner is alleged to have assaulted the deceased causing his death. The prayer for bail of the petitioner was twice rejected. The petitioner is in jail since 21.12.2009. It is submitted that the petitioner has already remained in jail for about six years but the trial has not been concluded. Considering the gravity of the office, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected. Learned counsel for the informant submits that 11 witnesses have already been examined and the trial is at its fag end. Only Investigating Officer is to be examined.

Patna High Court Cr.Misc. No.38305 of 2015 (2) dt.28-08-2015 2/2 Learned trial court is directed to hold the trial on day to day basis and conclude the same within three months from the date of receipt of this order.

The S.S.P., Patna is also directed to ensure the presence of the witness during the trial of S.Tr. No. 1188/2010, so that the trial must be concluded within three months.

If the trial is not concluded, the petitioner may renew his prayer for bail.
