The petitioner is languishing in jail since 13.09.2014 in a case instituted under Sections 304(B), 201, 120B and 34 of the Indian Penal Code in connection with Bihariganj P.S.Case No.146 of 2014 pending in the Court of Shri P.K.Choudhary, Judicial Magistrate, Ist Class, Udakishunganj, District-Madhepura. As per allegation, it is a case of murder of informant's married daughter, namely, Sanni Kumari by the accused persons due to non-fulfilment of demand of dowry.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 13.09.2014. The case is already in Sessions. Two witnesses have been examined on behalf of the

Patna High Court Cr.Misc. No.37111 of 2015 (3) dt.12-10-2015 prosecution. It has been submitted that it is a case of suicide. There is no direct or indirect allegation against the petitioner. On behalf of the State and counsel for the Informant, it has been submitted that the petitioner is the husband of the deceased. The trial has already commenced and within a period of six months all the witnesses shall be examined before the trial court.

Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the above named petitioner, same is dismissed.

Anyhow, the court below is directed to conduct the trial on day to day basis and conclude the same preferably within a period of six months from the date of receipt/ production of the order.
