In this case, the petitioners are apprehending their arrest in connection with Sursand P.S. Case No. 230 of 2018 registered for offences under sections 363/366(A)/34 of the Indian Penal Code.

A case of kidnapping has been lodged by the Informant making an allegation against the petitioners to have kidnapped his daughter but, the affidavit has been filed by the purported victim girl before the Judicial Magistrate, 1st Class, Sitamarhi stating that she has already entered into marriage with Chandan Kumar @ Mithilesh Kumar voluntarily without any pressure and is living peacefully.

No.7712 of 2019(2) dt.11-02-2019 2/2 In view of the affidavit, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Pupari, Sitamarhi in connection with Sursand P.S. Case No. 230 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as also subject to condition that whenever the police will call the petitioners for investigation/interrogation, they will remain present and if they would not present themselves, the privilege of grant of anticipatory bail shall be deemed to have been canceled.

It is made clear that the present anticipatory bail has been granted to the petitioner subject to condition of verification by the court below about the affidavit sworn by the victim girl. (Shivaji Pandey, J) rishi/- U T
