ANSARI ORAL ORDER 20-01-2015 This is an application, made under Section 439 of the Code of Criminal Procedure, seeking bail for the accused-petitioner, namely, Rahul Kumar, in connection with Laheri Police Station Case No. 255 of 2013, under Section 364 and 364(A) of the Indian Penal Code. Perused the above application and materials on record.

Heard Mr. Raj Kishor Prasad, learned counsel for the petitioner, and Mr. Surendra Kumar, learned Addl. Public Prosecutor, appearing on behalf of the State. By order, dated 13.02.2014, passed in Cr.

Miscellaneous No. 123 of 2014, the accused-petitioner's application for bail was rejected considering the fact that there were sufficient incriminating materials against the

Patna High Court Cr.Misc. No.38662 of 2014 (3) dt.20-01-2015 2/2 accused.

In view of the fact that accused above-named has remained in custody since 23.09.2013 in connection with the case aforementioned and perusal of the materials available does not reveal that the accused-petitioner's liberty on bail would adversely affect his trial, it is hereby directed that the accused above-named shall be released on bail of Rs. 10,000/- with two sureties, each of the like amount, subject to the satisfaction of the learned Additional Sessions Judge, III, Nalanda, at Bihar sharif, in Sessions Trial No. 66 of 2014.

In terms of the above directions, this bail application shall stand disposed of.
