JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 11-05-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 406, 420, 467, 468, 471, 120B of the Indian Penal Code.

It is alleged by the informant that one Smt. Sudha Devi had executed a sale deed in favour of the informant for a consideration amount of Rs. 12,00,000/- and petitioner was the witness to the sale deed. However, when the informant went to its purchased land for tilling, one lady introducing herself as Sudha Devi arrived at the said land and disclosed the informant that she is the real Sudha Devi and she never executed any sale deed in respect of land in question.

Learned counsel for the petitioner submits that the petitioner is not the vendor or vendee of the land and he is only

Moreover, informant has already filed Money Suit No. 04 of 2021 for the recovery of the same. Similarly situated co-accused persons namely, Md. Mojib and Bambam Kumar have already been granted bail by the coordinate Bench of this Court in Cr. Misc. No. 35339 of 2022 and Cr. Misc. No. 63578 of 2021 respectively.

Learned counsel for the State opposes the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Muzaffarpur, West in connection with Baruraj P.S. Case No. 66 of 2021 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) Alok Verma/- U T
