The petitioner seeks bail in a case under Section 302 and other sections of the Indian Penal Code and Section 27 of the arms Act.

The prayer for bail of the petitioner was earlier rejected vide order dated 09.01.2015 passed in Cr. Misc. No. 30648/2014. The petitioner is in jail since 10.03.2014. The allegation against the petitioner and two other accused persons are that they fired causing the death of Mahesh Singh but the police found the case not true against other two accused persons. The petitioner has already remained in jail for 11⁄2 years. The case was lodged after 16 days of the occurrence.

Considering the facts aforesaid, the above named

Patna High Court Cr.Misc. No.37249 of 2015 (3) dt.23-09-2015 2/2 petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran in Piprakothi P.S. Case No. 110 of 2013.
