The petitioner seeks bail in connection with Kateya P.S. Case No. 390 of 2021 instituted for the offences under Sections 414 and 34 of the Indian Penal Code read with Section 30(a) of the Bihar Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 28.10.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that the allegation is of recovery of 153 litres of liquor from an auto. Learned counsel for the petitioner submits that the petitioner is alleged to be the driver and as such was not knowing what the passenger had kept in the auto.

Patna High Court CR. MISC. No.7285 of 2022(2) dt.08-03-2022 2/2 Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody, is a person with clean antecedent and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-IIcum-Spl. Court Excise, Gopalganj in connection with Kateya P.S. Case No. 390 of 2021.
