The petitioner seeks bail in a case registered for the offences punishable under Sections 392 of the Indian Penal Code. The petitioner was arrested on mere suspicion and from his possession Nokia 1200 model, memory card and other articles are said to have been recovered, but the petitioner was not put on test identification parade. The petitioner was identified by the brother of the informant in the police station. The petitioner was never put on test identification parade.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount

Patna High Court Cr.Misc. No.39232 of 2015 (2) dt.07-09-2015 2/2 each to the satisfaction of Sri Rajeev Kumar II, the learned Judicial Magistrate 1st Class, Bhagalpur in Habibpur P.S. Case No. 15 of 2015.
