JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. There is very serious accusation against the petitioner that he pushed the informant's husband from a running train when the informant's husband made protest regarding the behaviour of the petitioner and others. The dead body of informant's husband was recovered and she identified the petitioner when he was caught by the police.

Regard being had to the facts and circumstances of the case as well as submissions of the parties, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Kishanganj (Barsoi) Railway P.S. Case No. 01 of 2014 corresponding to G.R. No. 05 of 2014 pending in the court of Railway Judicial Magistrate 1st Class, Katihar stands rejected.

Patna High Court Cr.Misc. No.25831 of 2014 (5) dt.09-01-2015 However, the concerned Magistrate should commit the case of the petitioner to the court of Sessions as early as possible, if the same has not been committed as yet and after commitment, the learned Sessions court should expedite the trial of the petitioner.
