Mr. Nachiketa Jha, Advocate ====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 05-05-2026 Heard learned counsel for the petitioners, learned counsel for the informant and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in connection with Kudhani P.S. Case No. 162 of 2025, instituted for the offences under Sections 103(1), 87, 61(2), 137(2) of the B.N.S.
3. As per the prosecution case, daughter of the informant, who is a student, was kidnapped by Petitioner No. 1, Ravi Kumar while going to College. When she did not return, her family members searched for her. It is further alleged that the son of the informant was threatened by the petitioners and
Patna High Court CR. MISC. No.7499 of 2026(5) dt.05-05-2026 2/3 on 23.11.2025, he was found dead.
4. Learned counsel for the petitioners submits that petitioners are innocent and have falsely been implicated in this case. Daughter of the informant and Petitioner No. 1, Ravi Kumar were in love affairs and both had married with their own will. No one had kidnapped the daughter of the informant as alleged. Son of the informant has committed suicide and only on the false allegation petitioners have been implicated in this case. F.S.L. report shows that no poison has been found in the viscera of the deceased and there is no ante-mortem injury, except one non-continuous oblique ligature mark on the neck. Independent witnesses have stated that due to social stigma, son of the informant has committed suicide. Petitioners have no role in the death of the deceased. Petitioners have no criminal antecedent. They undertake to co-operate in the investigation and trial.
5. Learned A.P.P. for the State and learned counsel for the informant oppose the prayer for anticipatory bail.

Considering the facts and circumstances of the case, submission of learned counsel for the parties, report of the F.S.L. and clean antecedent of the petitioners, in the event of arrest or surrender before the Court below within six weeks from today, the petitioners be released on bail upon furnishing
Patna High Court CR. MISC. No.7499 of 2026(5) dt.05-05-2026 3/3 bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. I, Muzaffarpur (West), Muzaffarpur in connection with Kudhani P.S. Case No. 162 of 2025, subject to the conditions laid down in Section 482 (2) of the Bharatiya Nagrik Suraksha Sanhita (B.N.S.S.), 2023.
