2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 399 and 402 of the Indian Penal Code, Sections 25(1-B)(a), 26 and 35 of the Arms Act and Sections 8, 8(C), 21(b) and 20(b)(ii)(c) of the NDPS Act.
3. The case of the prosecution is that one country made pistol, one live cartridge, 14 gm of smack and a mobile was recovered from the physical possession of the petitioner.
4. Learned counsel for the petitioner submits that the contraband seized from the possession of the petitioner is more than small quantity but much less than the commercial quantity. The petitioner is having no criminal antecedent till
Patna High Court CR. MISC. No.6103 of 2025(2) dt.28-02-2025 2/2 today as has been submitted by learned counsel for the petitioner. The petitioner is in custody since 19.06.2024.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Bajpatti P.S. Case no. 168 of 2024 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Sitamarhi.
7. Accordingly, the present bail application stands allowed.
