2. The petitioner is in custody in connection with Nauhatta P.S Case No. 228/2024 registered for the offences punishable under Sections 25(1-B)(a),26,35 of the Arms Act.
3. As per allegation in the FIR, one country made pistol was recovered from the possession of the petitioner.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He next submits that no independent witness has supported the prosecution case. Petitioner's name has been figured only and only due to conspiracy made against him. Moreover, nothing incriminating has been recovered from the conscious possession

He further submits that petitioner is law abiding citizen and there is no chance of his absconding or tampering with the evidences. It is also submitted that petitioner is in judicial custody since 19.10.2024 having clean antecedent.
5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.

On perusal of the FIR, impugned order dated 17.12.2024, it appears that there is no recovery from the conscious possession of the petitioner and petitioner possess clean antecedent also considering the aforesaid facts and circumstances of the case and submissions made on behalf of the learned counsel for the petitioner, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Saharsa in connection with Nauhatta P.S Case No. 228/2024.
