1. Heard learned counsel for the petitioner and the learned APP for the State.

2. Petitioner seeks regular bail in connection with Amour P.S. Case No. 135 of 2023 dated 02.05.2023 registered for the offence(s) punishable under Section(s) 417, 419, 420, 465, 467, 468, 471, 472, 473, 474, 120B/34 of the Indian Penal Code

3. The main submissions advanced by the learned counsel for the petitioner are that the petitioner has got fair and clean antecedent and as per the FIR, the main allegation is against co-accused Sarwan Kumar Rai from whose house the incriminating materials including the Laptop, which were used in downloading the sale deeds and thereafter they were used in committing the offences of cheating and other offences, were recovered but the petitioner was not apprehended at the spot

Patna High Court CR. MISC. No.7818 of 2024(2) dt.19-02-2024 2/2 and his name surfaced in the confessional statement of the coaccused Sarwan Kuamr Rai who has been granted bail by a coordinate bench of this court vide order passed in Cri. Misc. No. 55193 of 2023 and the petitioner has been languishing in jail since 15.10.2023 and against him, the investigation has been completed.

4. Learned APP appearing for the State has opposed the bail prayer of the petitioner.

5. Considering the above submissions and mainly the privilege of bail to the main accused having been granted by a co-ordinate bench of this court as mentioned above, coupled with the petitioner's fair and clean antecedent and completion of investigation against him, this court is inclined to accept his bail prayer. Accordingly, let the petitioner named-above be enlarged on bail in connection with Amour P.S. Case No. 135 of 2023 on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
