The petitioners seek bail in a case registered for the offences punishable under sections 302 and other allied sections of the Indian Penal Code and section 27 of the Arms Act.
The informant named 12 persons and alleged that firstly Buchcho Mehta pointed Pistol at her husband Nand Kishore Mehta and when the informant intervened, Buchcho Mehta, Digamber Mushar, Dablu Mehta and Pintu Mehta made indiscriminate firing causing death of her husband on the spot. The petitioners are of course named in the F.I.R. but no specific allegation is made against them. The petitioners did not even fire.
Patna High Court Cr.Misc. No.37516 of 2015 (2) dt.25-08-2015 Similarly situated co-accused Makko Mehta has already been enlarged on bail vide Criminal Misc. No. 22313 of 2015. Considering the facts aforesaid, the petitioners above named, are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Ashok Kumar II, Judicial Magistrate, 1st Class, Uda Kishunganj, Madhepura in connection with Chousa (Fulout O.P.)
