JUSTICE SUDHIR SINGH ORAL ORDER 15-03-2021 Vide order dated 06.03.2020, notices were issued upon the opposite party No.2. As per the office note dated 10.03.2021, service of notice has not been received.

Heard learned counsel for the petitioner and learned APP for the State.

The petitioner was granted provisional anticipatory bail by order dated 06.03.2020.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The

Patna High Court CR. MISC. No.5784 of 2020(4) dt.15-03-2021 2/2 case is triable by the Magistrate. The petitioner has relied upon the judgment of this Court in the case of Md. Naimul Haque Ansari @ Naimul Haque Ansari & Ors. Vs. The State of Bihar, reported in 2006(3) PLJR 182.

On behalf of the State, it is submitted that the petitioner is named in the Complaint case.

Considering the aforesaid facts and circumstances, the provisional anticipatory bail granted to the petitioner by order dated 06.03.2020 is, hereby, confirmed in connection with Complaint case No.370 of 2017 pending in the court of A.C.J.M., Bikramganj, Rohtas.
