Heard learned counsel for the petitioner as well as learned APP for the State.

The petitioner apprehends his arrest in connection with Kateya P.S. Case No. 365 of 2021, registered for the offences punishable under Sections 341, 323, 427, 447, 325, 504, 506, 147, 149, 307 of the Indian Penal Code. Learned counsel for the petitioner has submitted that there is allegation on the petitioner that he assaulted the informant on his head and there is also allegation against coaccused Chhotelal Singh that he assaulted the

Patna High Court CR. MISC. No.6652 of 2022(2) dt.24-08-2022 2/2 informant/complainant on his head. He has further submitted that the anticipatory bail petition of co-accused Chhotelal Singh was allowed by the learned court below.

The petitioner is directed to surrender before the court below and make a prayer for regular bail. The learned court below shall dispose of the regular bail petition without being prejudiced by this order. I do not see any reason as to why the same benefit as co-accused Chhotelal Singh should not be extended to the present petitioner.

With these observations, the criminal miscellaneous petition is disposed of.

Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
