The petitioner seeks bail in a case registered for the offences punishable under Section 392 of the Indian Penal Code. Petitioner is not named in the First Information Report. Nothing has been recovered from the possession of the petitioner. Apprehended accused disclosed the name of the petitioner that the petitioner provided motorcycle to them for committing crime. Motorcycle is in the name of the sister-in-law (Bhabhi) of the petitioner. It is submitted that there is no evidence to show that the petitioner participated in the crime except confession of the accused that too petitioner only provided them motorcycle. Petitioner is in jail since 05.07.2015.

Considering the facts aforesaid, the petitioner above named

Patna High Court Cr.Misc. No.39395 of 2015 (2) dt.27-08-2015 P2/2 is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Kadwa P.S. Case No. 85/2015.
