====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 23-06-2020 Due to COVID-19 Pandemic, the matter is being taken up by way of virtual Court proceeding.
The matter has been listed under the heading 'For Orders' under the orders of Hon'ble the Chief Justice. Heard learned counsels for the parties.
The following relief has been sought for on behalf of the petitioner in the present writ application. "For issuance of an appropriate writ, order or direction commanding the respondents to pay the retiral dues viz amount of G.I.C., Gratuity, Leave Encashment and dues salary of seven months in terms of the case of Kamla Prasad Sharma and others in the Multi State Co-operative Land Development Bank in C.W.J.C. No. 14799 of 2012 to the petitioner and further be pleased to pay the admissible arrears of dearness allowance w.e.f. July, 2001 to October, 2008."
Patna High Court CWJC No.3126 of 2020(3) dt.23-06-2020 2/3 Learned counsel for the petitioner seeks liberty to file/make a fresh representation before the respondent no. 1 i.e., The Managing Director, Multi State Co-operative Land Development Bank, Budh Marg, Patna, for redressal of his grievance relating to the post retiral benefits. Considering the submission made on behalf of the petitioner, the petitioner is granted liberty to file/make a detailed representation before the respondent no. 1 i.e., The Managing Director, Multi State Co-operative Land Development Bank, Budh Marg, Patna, for redressal of his grievance relating to the post retiral benefits.
In case, any such representation is filed/made by the petitioner before the respondent no. 1 i.e., The Managing Director, Multi State Co-operative Land Development Bank, Budh Marg, Patna, the respondent no. 1 shall consider the representation of the petitioner and pass an appropriate order, in accordance with law, within a period of four months, from the date of filing/making of such representation. The respondent no. 1 i.e., The Managing Director, Multi State Co-operative Land Development Bank, Budh Marg, Patna, shall be under obligation to make the payment of the admitted dues, if any, of the petitioner.
