2. This application is filed for modification of order dated 15.01.2024 passed in Cr. Misc. No. 81876 of 2023.
3. Learned counsel appearing on behalf of the petitioners has submitted that the petitioners have been granted anticipatory bail vide order dated 15.01.2024 passed in Cr. Misc. No. 81876 of 2023, by which the petitioners were granted anticipatory bail with a direction to surrender before the Court below within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail bond of Rs. 20,000/-
Patna High Court CR. MISC. No.12233 of 2025(2) dt.21-02-2025 2/2 (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the learned court concerned, Patna in connection with Phulwari Sharif P.S. Case No. 1614 of 2022, subject to conditions as laid down under section 438(2) of the Code of Criminal Procedure, the petitioner could not furnish the bail bonds before the Court below within the stipulated time because the petitioners were suffering from chronic acute abdomen pain and vomiting and under treatment from 20.01.2024 to 15.02.2024 in Arun Nursing Home.
4. Learned counsel for the petitioners seeks permission to extend the time for furnishing the bail bond of the petitioners.
5. In view of the above, let the time to surrender of the petitioners, as ordered on 15.01.2024 passed in Cr. Misc. No. 81876 of 2023 be further extended by four weeks from the date of receipt of this order.
6. Accordingly, the modification application is allowed and the order dated 15.01.2024 passed in Cr. Misc. No. 81876 of 2023 is modified to the above extent. (Chandra Prakash Singh, J) shivam/- U T
