The petitioner apprehends his arrest in Warisnagar P.S. Case No. 271 of 2021, registered for the offences punishable under Sections 420, 428 and other allied sections of the Indian Penal Code, section 11 of the Prevention of Cruelty to Animal Act, section 3/4 of the Bihar Prevention and Improvement of Animal Act, Environment of Protection Act, the Solid Waste (Management and Handling) Rules, Transport of Animals Rules, Central Pollution Control Board, section 51,60 of the Disaster Management Act, Section 3 of the Epidemic Disease Act, Local Municipality Rules.
Allegation against this petitioner is that he is running illegally slaughter house-cum-processing unit and exported the beef in the market of Kolkata and Hyderabad. The complainant
Patna High Court CR. MISC. No.6486 of 2022(2) dt.01-08-2022 2/2 during inspection found large and small chunks of body parts of the prohibited animals lying on the floor which is hazardous for health of human.
It is submitted that specific accusation is against coaccused Md. Azad and associates, as the alleged premises where slaughter house is running belongs to Md. Azad and there is no specific allegation against this petitioner. It is further submitted that petitioner has been dragged in this case simply because he is resident of Dharampur. Petitioner is neither owner nor the employee of the premises in question. Petitioner has got clean antecedent.
Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Samastipur in connection with Warisnagar P.S. Case No. 271 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
