The aforementioned writ petition was dismissed for non-prosecution. This Court has recorded that there is no represention on behalf of the petitioner on 31.08.2022 so also on 14.09.2022.

2. In the interest of litigant and for the reasons stated

Patna High Court MJC No.240 of 2023(3) dt.31-08-2023 2/2 in the application and affidavit, order dated 14.09.2022 passed in CWJC No. 25037 of 2013 stands recalled. CWJC No. 25037 of 2013 stands restored to its original file and number. Accordingly, the present MJC- restoration petition stands allowed subject to payment of cost of Rs. 2,000/-. Cost shall be remitted in Patna High Court Legal Services Committee within a period of four weeks.

3. Registry is hereby directed to list CWJC No. 25037 of 2013 before the roster Bench.
