JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-02-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner being younger brother-in-law of the deceased is languishing in jail custody since 31.07.2014 in a case which was registered under section 302,504/34 of the Indian Penal Code but after investigation, police submitted charge sheet for the offence punishable under section 306/34 of the Indian Penal Code. In course of investigation, the statement of daughter of deceased was recorded at Para-8 of the case diary, in which she stated that due to petty family feud her mother committed suicide. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with

Patna High Court Cr.Misc. No.37861 of 2014 (3) dt.05-02-2015 2/2 two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kishanganj in connection with Terahgachh P.S.case No. 92 of 2013.
