JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02-04-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be husband of the deceased and has been made accused in a case registered for the offences punishable under Sections 304B, 201/34 of the Indian Penal Code. The marriage of petitioner was solemnized with the deceased in the year 2010 and allegedly, deceased died in mysterious circumstances in the year 2012 i.e. within two years of her marriage.
The learned trial court has reported that trial of the petitioner has already commenced and one witness has been examined in course of trial.
Regard being had to the facts and circumstances of the case as well as submissions of the parties, I am not inclined to
Patna High Court Cr.Misc. No.37131 of 2014 (4) dt.02-04-2015 release the petitioner on bail and hence, his prayer for bail in connection with Sessions Trial No. 351 of 2013 arising out of Dinara P.S. Case No. 280 of 2012 pending in the court of 7th Additional Sessions Judge, Rohtas at Sasaram stands rejected. However, learned trial court should expedite the trial of the petitioner and try to conclude the same as early as possible, preferably within nine months from the date of receipt/production of copy of this order because petitioner is languishing in jail custody since 09.04.2013 without any substantial progress in his trial.
