The petitioner seeks bail in a case registered for offence punishable under Sections 302, 120(B) and 34 I.P.C. and 27 of Arms Act.
The allegation against the petitioner and other is that they had intercepted the deceased and Guddu Yadav, one of them shot fire, causing his death.
It is submitted that Guddu Yadav, the main assailant, has been granted bail vide order dated 16.08.2011 passed in Cr. Misc. No. 4070 of 2011, (Annexure-2) and the petitioner has been in custody since 25.01.2010.

No.39760 of 2014 (3) dt.06-02-2015 2/2 Considering the facts and circumstances, the above named petitioner, Amar Yadav is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Adhoc Sessions Judge- IV, Araria arising out of Jogbani P.S. Case No. 49/ 1997 in connection with Sessions Trial No. 82/2011 with following conditions :- I) One of the bailors will be the close relative of the petitioner.
II) The petitioner will not indulge in similar or in any other offence.
III) The petitioner will be well represented in the Court.
IV) In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the Court concerned.
