Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Admittedly, the victim returned to his home and his statement was recorded by the police on a separate paper, which has been attached with the case diary. In the aforesaid statement, the victim clearly stated about the involvement of the petitioner in the alleged crime but in course of trial, when the statement of victim was recorded in Sessions Trial No. 290 of 2014 as prosecution witness No. 2, the victim did not disclose the name of the petitioner and also declined to have identified the petitioner in

Patna High Court Cr.Misc. No.38392 of 2014 (3) dt.09-02-2015 2/2 dock.

Considering the statement recorded in Sessions Trial No. 290 of 2014, let the petitioner named above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Laxmipur P.S. Case No. 160 of 2012 to the satisfaction of Chief Judicial Magistrate, Jamui.
