Petitioner is in jail custody since 20.6.2014. Admittedly, victim has already returned to her home safely. Statement of the victim has been recorded under section 164 Cr.P.C which is evident from perusal of para 86 of the case diary. Although victim has named the petitioner in her statement recorded under section 164 Cr.P.C but no specific overt-act has been attributed against the petitioner.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Smt. Noor Sultana, Judicial Magistrate, Ist Class, Vaishali at Hajipur/concerned court, in Baligaon P.S. Case no. 38/2014.
