ANJANA PRAKASH ORAL JUDGMENT Date: 26-03-2015 Heard learned counsel for the Petitioner and the State. This revision application has been filed for setting aside the order dated 5.8.2014 passed by the Sessions Judge, Saran, Chapra in Criminal (Juvenile) Appeal No.75 of 2014, by which he has affirmed the order dated 18.7.2014 passed by the Juvenile Justice Board, Saran at Chapra, by which he has refused to release the Petitioner in J.J.B. case No.1212 of 2014 arising out of Chapra Rail P.S. case No.7 of 2014.
The Petitioner seeks release in J.J.B. case No.1212 of 2014 arising out of Chapra Rail P.S. case No.7 of 2014 instituted for the offence under Sections 395 and 397 of the Indian Penal Code,
Patna High Court CR. REV. No.783 of 2014 dt.26-03-2015 2/2 pending in the court of Juvenile Justice Board, Saran at Chapra. A report was called for from the Principal Magistrate, Juvenile Justice Board, Saran at Chapra by this Court with regard to the number of cases pending in regard to the Petitioner. The Principal Magistrate, Juvenile Justice Board, Saran at Chapra has reported that there was two cases pending against the Petitioner and he is making an effort to conclude the enquiry within four months.
Considering the merits of the case, I am not inclined to release the petitioner since there is every likelihood of him mingling with anti social elements as is apparent from the contents of the case diary.
Hence, the application is rejected.
The Principal Magistrate, Juvenile Justice Board, Saran at Chapra is directed to conclude the enquiry positively within a period of four months from the date of receipt of this order without granting unnecessary adjournments to any party.
