The petitioner seeks bail in a case registered for the offence under Sections 272, 273/34 of the I.P.C., Section 30(a) of Bihar Prohibition and Excise Act and Sections 20 / 22 of the N.D.P.S. Act.

25 liters of country-made liquor has been recovered from Dak Bunglow and petitioner alongwith one co-accused was apprehended and from possession of petitioner, 300 gm. of Ganja was recovered.

It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner. The alleged recovered Ganja is less than small quantity, whereas aforesaid liquor has been seized from Dak Bunglow, which is a public place. Petitioner claims clean antecedent and he is in custody since 21.11.2021. Investigation has already been completed.

Patna High Court CR. MISC. No.6461 of 2022(2) dt.05-04-2022 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the quantity of recovery, clean antecedent and period of custody, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, Excise Court No.2, Muzaffarpur / learned Special Judge Excise, Muzaffarpur in connection with Saraiya P.S. Case No. 780 of 2021.
