Petitioner being the husband of the victim has renewed his prayer for bail is languishing in custody since 21.01.2014 in a case registered for the offences punishable under Sections 304B, 201, 120B of the Indian Penal Code. The accusation is of killing the daughter of the informant after two years of marriage for non-fulfillment of dowry demand.

Learned counsel for the petitioner submits that victim was suffering from tuberculosis and due to the said disease the evidence has also come during the trial to that effect. The report of the learned trial court dated 19.09.2015 reflects that out of nine charge-sheeted witnesses three have been examined and trial is likely to be concluded

Patna High Court Cr.Misc. No.39218 of 2015 (4) dt.18-05-2016 within six months.

In that view of the matter, this Court is not inclined to review the earlier application of the petitioner. The application is disposed of with liberty to the petitioner that if the trial is not concluded within six months for non latches on the part of the petitioner, petitioner will be released on bail.

It is expected from the learned trial court to conclude the trial expeditiously without giving adjournment to either side.

The application stands dismissed.
