2. The petitioner seeks regular bail in the present case registered for the offence under Sections 420, 467, 468, 272, 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

3. As per the prosecution case, petitioner is accused to be involved in smuggling of illicit liquor.

4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 26.12.2023. He further submits that co-accused namely Bablu Kumar has been granted bail by a co-ordinate Bench of this Court dated 06.01.2022 passed in Cr. Misc. No. 36878 of 2021.

5. Learned A.P.P. has vehemently opposed the prayer for bail and has submitted that petitioner is an absconder.

6. Considering the fact that other co-accused has been granted bail, this application for regular bail is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned Special Excise Court No. 01, Muzaffarpur/concerned Court below in connection with Sakra P.S. Case No. 556 of 2019 subject to condition that:- (i) The petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and on absence on two consecutive dates without sufficient reason, the bail bond shall be cancelled by the Court below.

(ii) One of the bailor should be close blood relative of the petitioner.
