According to the prosecution case itself, it were co-accused Shamshad Khan and Kamar Khan who opened fire at the deceased. So far as petitioner is concerned, it is stated that he, too, made firing but admittedly, none of the person sustained any injury due to firing of the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial Magistrate, Sherghatti District Gaya in Sherghatti P.S. Case no. 117/2014.
