JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-03-2020 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Rohtas P.S. Case No. 217 of 2019 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 504, 506 of the Indian Penal Code.

Taking note of this fact that injured of this case sustained two grievous injuries on his head and petitioners are said to have participated in the alleged crime, I do not think it proper to grant privilege of anticipatory bail to them. Accordingly, their prayer for anticipatory bail in connection with Rohtas P.S.Case No. 217 of 2019, pending in the court of learned Sub Divisional Judicial Magistrate, Dehri stands

Patna High Court CR. MISC. No.5081 of 2020(2) dt.03-03-2020 2/2 rejected.

However, if the petitioners surrender and seek regular bail within six weeks from today, the concerned court shall consider their regular bail application on its own merit without being prejudiced by this rejection order.
